Collaborative Law is a modern, more personal way of resolving disputes without going to Court. Every decision and
outcome is chosen by the disputing parties - not by a Court (which has limited options to choose from). This means
every decision about children, money, property & assets should be more fair and satisfactory for everyone
concerned. Because of the personal nature of the Collaborative method, it is often an excellent way to approach
separation & divorce.
How the Collaborative Method Works
- each partner has their own lawyer
- both parties enter into an agreement to not commence Court proceedings
- during a series of meetings, both parties reach agreements about how each detail of their separation/divorce will be
handled
- these agreements form the basis of a contract which binds the parties to the decisions they have made
Why do I need a Lawyer?
Your lawyer will act as a guide and adviser during meetings. They will ensure that all important issues are covered,
and will provide explanations and advice about the complex legal aspects of all issues & decisions. This keeps the
process moving smoothly and avoids legal problems.
What about really complex issues?
Some issues are best resolved with assistance from other professionals or experts. The Collaborative process may
therefore include input from mediators, counsellors, accountants or financial advisers. These specialists will help
keep the entire dispute solving process running smoothly, and ensure everyone understands all of the issues and
choices.
The Benefits
When compared to Court-based litigation, clients who follow a Collaborative approach achieve outcomes they are more
satisfied with, in less time, with far less stress, and at much less expense (as little as 10% of the cost of Court-
based litigation).
This helps separating & divorcing partners to maintain respect and consideration for each other - which is
especially important where children are involved.
